By accessing or using Quikermart, you agree to these Terms & Conditions, our Privacy Policy, and all applicable laws. These terms are designed to ensure a secure, transparent, and fair business environment for all users.
1. Use of Quikermart
· Quikermart provides an online B2B platform designed solely for legitimate business transactions in the hosiery and related textile industries.
· Users must act responsibly and professionally, ensuring that all interactions, negotiations, and transactions conducted through the platform comply with these terms.
· Unauthorized use of the platform for personal or non-commercial purposes is prohibited.
· By continuing to use Quikermart, users confirm their understanding and acceptance of all platform rules, updates, and notifications.
· Any misuse of the platform, including attempts to manipulate pricing, mislead buyers/sellers, or harm Quikermart’s reputation, will result in immediate suspension or termination of access.
2. Eligibility to Use the Platform
· Quikermart is intended exclusively for registered businesses and authorized representatives of those businesses.
· Users must be legally capable of entering into binding commercial agreements under Indian law.
· Individuals or entities operating without proper business registration or tax identification (such as GST) are not permitted to register.
· Minors and unverified individuals are strictly prohibited from using or accessing the platform.
· Users must provide verifiable details including company name, address, and registration proof during signup to maintain the authenticity of the B2B network.
3. Account Responsibility and Security
· Users must ensure that all account details, including login credentials and business information, are accurate and current at all times.
· Sharing of account access, using another business’s credentials, or impersonating another entity is strictly prohibited.
· Users are solely responsible for all actions taken under their account. Any unauthorized activity should be reported immediately to Quikermart support.
· Quikermart reserves the right to suspend or terminate accounts if any fraudulent, suspicious, or unethical behavior is detected.
· You are encouraged to use strong passwords and maintain confidentiality to protect against misuse and data breaches.
4. Privacy and Data Protection
· Quikermart values user privacy and ensures that all collected data is used strictly for operational, marketing, and transactional purposes.
· By registering, you consent to the collection, storage, and processing of your information within India.
· We employ reasonable data security measures; however, we cannot guarantee absolute protection against cyber threats.
· Users are responsible for keeping their submitted data accurate and updated to avoid communication or transaction errors.
· Data may be shared with logistics partners, payment gateways, or legal authorities when necessary for operational compliance or fraud prevention.
5. Intellectual Property Rights
· All Quikermart content—including the website design, graphics, product listings, software, and text—is protected under applicable copyright and trademark laws.
· Users may not copy, reproduce, distribute, or exploit any part of the site without written permission from Quikermart.
· Vendors are responsible for ensuring that their product listings, images, and brand materials do not infringe upon third-party rights.
· Any verified claim of intellectual property violation may result in removal of the listing and potential legal action.
· False infringement claims will also be treated as a breach of these Terms and may lead to account suspension or legal liability.
6. Marketplace Transactions
· Quikermart functions purely as an intermediary platform connecting buyers and sellers. We are not directly involved in any sale or purchase contract.
· Sellers are fully accountable for product quality, accuracy of descriptions, lawful sourcing, and timely delivery.
· Buyers must ensure that purchases align with their business requirements and legal trade practices.
· Fraudulent activities such as false advertising, counterfeit goods, or fake reviews are strictly prohibited.
· Disputes between buyers and sellers should be resolved amicably; however, Quikermart reserves the right to intervene and take administrative action when platform integrity is at risk.
7. Payments and Cash on Delivery (COD)
· Payments can only be made through Quikermart-approved methods, including digital transfers, UPI, or COD (where applicable).
· For COD orders, an advance payment of up to 30% of the total order value is mandatory to confirm the order.
· If a buyer refuses to accept a confirmed delivery, the advance amount is non-refundable, covering logistics, manpower, and handling costs.
· Quikermart does not mediate financial disputes but advises both parties to maintain transparent records of all payment communications.
· Users agree to make timely payments and acknowledge that delays or defaults may lead to suspension of buying privileges.
8. Shipping and Delivery Policy
· Orders are generally processed within three (3) business days and shipped using verified courier services.
· Delivery timelines typically range from 1 to 20 business days, depending on the destination and courier network efficiency.
· While Quikermart aims for timely deliveries, external factors such as transport strikes, weather, or natural disasters may cause unavoidable delays.
· Buyers may opt for insured shipments to mitigate risks of loss or damage during transit.
· Quikermart is not liable for courier delays, damages, or loss once goods have been handed over to the shipping provider.
9. Returns, Exchanges, and Claims
· Most hosiery and textile items sold on Quikermart are final sale unless explicitly stated otherwise by the seller.
· For any claim regarding missing, defective, or incorrect items, buyers must submit an unedited unboxing video clearly showing the outer packaging, product label, and contents within 24–48 hours of delivery.
· Claims without such evidence may not be entertained.
· All refund or exchange requests must follow Quikermart’s separate Return & Refund Policy, which outlines the conditions, timelines, and documentation required.
· Sellers are responsible for verifying product quality before dispatch. Quikermart retains the right to temporarily hold payments or restrict seller access if repeated quality complaints are received.
· This clause ensures fair resolution of disputes while protecting genuine businesses from false claims.
10. Service Availability and Interruptions
· Quikermart may occasionally undergo maintenance, updates, or upgrades to enhance user experience and system security.
· Temporary interruptions may occur due to scheduled maintenance, server downtime, or external factors such as power failures or internet disruptions.
· While we strive to minimize service interruptions, Quikermart is not liable for losses, delays, or missed business opportunities caused by temporary unavailability.
· Users are encouraged to plan purchases and listings in advance to avoid disruption.
· Any data loss or transaction delay resulting from unforeseen technical issues will be addressed with reasonable effort, but users acknowledge that complete continuity of service cannot be guaranteed.
11. Warranties
· Quikermart operates strictly on an “as-is” and “as-available” basis without express or implied warranties.
· We make reasonable efforts to maintain the accuracy of listings and platform performance but cannot guarantee that the website will always be error-free or uninterrupted.
· Sellers warrant that the goods offered are authentic, legally sourced, and suitable for commercial use.
· Buyers agree to inspect goods upon delivery and raise complaints promptly if any issues arise.
· Quikermart disclaims all liability for third-party content, vendor misrepresentation, or price discrepancies.
· Users agree that they are engaging in B2B trade at their own risk and are responsible for due diligence before completing any purchase.
12. Limitation of Liability
· Quikermart and its affiliates, officers, and employees are not liable for any indirect, incidental, special, or consequential damages — including loss of profit, goodwill, or data — resulting from use of our services.
· Our total liability for any claim, regardless of cause, shall not exceed the transaction value paid to Quikermart within the one (1) month preceding the claim.
· Users agree that Quikermart serves only as a facilitator, not a party to transactions.
· Some jurisdictions may not allow limitation of certain damages; however, users agree that Quikermart’s liability remains limited to the fullest extent permitted by law.
· This ensures the company’s protection from undue financial exposure arising from user disputes or third-party actions.
13. Indemnification
· Users agree to indemnify and hold harmless Quikermart, its directors, partners, and employees from any claims, damages, liabilities, or expenses (including legal fees) arising out of:
1. Violation of these Terms;
2. Breach of representations or warranties;
3. Unauthorized or illegal use of the platform; or
4. Violation of third-party rights.
· Quikermart reserves the right to assume exclusive defense of any such claim at the user’s expense.

· Users are responsible for keeping their contact information up to date to avoid missing important notifications.
15. Governing Law and Dispute Resolution
· These Terms shall be governed by and interpreted under the laws of India.
· Any dispute arising from the use of Quikermart shall be resolved under the exclusive jurisdiction of the courts in Delhi, India.
· Before resorting to litigation, parties are encouraged to attempt amicable settlement or mediation through Quikermart’s internal dispute team.
· This clause promotes fairness and efficiency while ensuring that all legal proceedings remain within a clear jurisdiction.
16. Jurisdiction for Disputes
· All disputes, claims, or controversies relating to use of the website or purchase of products shall fall under the exclusive jurisdiction of Delhi courts.
· By transacting on Quikermart, users explicitly consent to this jurisdiction and waive any right to object to venue or forum selection.
· This provides a uniform and legally predictable framework for all parties conducting B2B trade through Quikermart.
17. Return Policy Reference
· This clause directs users to the separate Return & Refund Policy, which provides detailed procedures for return requests, refund eligibility, and evidence requirements.
· Keeping this as a separate document allows Quikermart to update procedures flexibly without amending these core Terms.
· All return-related actions must strictly comply with that policy, ensuring consistent dispute resolution and transparency between buyers and sellers.
· Users acknowledge that by transacting on the platform, they agree to the conditions mentioned therein.
18. Electronic Communications and Signatures
· All electronic agreements, communications, and signatures exchanged via Quikermart hold the same legal effect as written contracts.
· Users authorize Quikermart to rely on such digital consent for all business interactions.
· This clause enables smooth online contracting and removes the necessity for physical paperwork, aligning with India’s IT Act, 2000.
19. Missing or Incorrect Products
· If users receive missing or incorrect items, they must submit an unedited unboxing video showing the package from all angles, including labels and contents.
· This evidence helps Quikermart verify discrepancies and resolve issues fairly.
· Claims without such proof or submitted after the specified time may not be accepted.
· Quikermart’s decision, based on available evidence, shall be final.
· This clause ensures fairness while preventing fraudulent or false claims.
20. Prohibited Activities
· Users are strictly forbidden from engaging in activities such as:
o Fraud, impersonation, or creation of fake listings;
o Hacking, data scraping, or spamming;
o Uploading malware or harmful content;
o Misuse of others’ intellectual property;
o Conducting illegal or deceptive trade.
· Violation of this clause may lead to immediate termination of account, forfeiture of pending payments, and potential legal action.
· Quikermart reserves full rights to monitor and act against misuse to maintain a safe and trusted B2B environment.
21. User Contributions & Submissions
· This clause covers all content users upload or share on Quikermart—such as reviews, feedback, messages, or product photos.
· Users retain ownership of their content but grant Quikermart a worldwide, royalty-free, perpetual license to use, reproduce, and display it for marketing or service-improvement purposes.
· Contributions must be truthful, lawful, and non-infringing. Content containing defamatory, misleading, or offensive language will be removed.
· Quikermart reserves the right to edit, moderate, or delete any submission that violates community standards or legal guidelines.
· By contributing, users agree not to post confidential or proprietary information belonging to third parties.
· This ensures that all public content on Quikermart promotes transparency, professionalism, and brand authenticity while allowing the platform to utilize valuable user insights ethically.
22. Miscellaneous
· These Terms, along with the Privacy Policy and other referenced documents, form the entire legal agreement between the user and Quikermart.
· Failure to enforce any right or provision does not constitute a waiver of that right.
· Quikermart may assign, transfer, or subcontract its rights or obligations under these Terms without prior notice.
· Delays or failures caused by circumstances beyond our control—such as natural disasters, strikes, or technical failures—will not constitute a breach of contract.
· If any provision of these Terms is deemed invalid, the remaining clauses will continue to be fully enforceable.

· By doing so, users authorize Quikermart to access limited data (like profile name, image, or contacts) under each platform’s privacy policy.
· Quikermart does not control and is not responsible for the privacy practices, outages, or data breaches of third-party services.
· Users should review third-party terms before linking accounts.
· This clause ensures transparency, compliance with data-sharing norms, and limits Quikermart’s liability if an external service malfunctions or exposes user data.
· Maintaining a clear boundary between Quikermart and external integrations enhances user trust and aligns with global privacy standards such as GDPR principles.
24. General Provisions
· These Terms collectively represent the full understanding between users and Quikermart, superseding all previous oral or written communications.
· Use of Quikermart does not establish any partnership, joint venture, employment, or agency relationship.
· Users may not assign their rights or obligations without Quikermart’s written consent.
· Quikermart reserves the right to update these Terms periodically, and continued use of the platform after such updates constitutes acceptance.

· All sellers on Quikermart must ensure that every hosiery product listed is authentic, new, and accurately described.
· Sellers are responsible for verifying fabric quality, labeling accuracy, sizing, and packaging compliance with Indian textile regulations.
· Products must not infringe on any third-party brand or intellectual property.
· In case of repeated customer complaints regarding counterfeit or defective goods, Quikermart reserves the right to delist the seller, forfeit pending payments, and report the matter to relevant authorities.
· Sellers must retain original purchase invoices, batch details, or manufacturing records for verification upon request.
· This clause safeguards buyers and upholds marketplace credibility, ensuring all listed hosiery products meet professional standards of trade and authenticity.
27. Tax & GST Compliance
· All sellers and buyers agree to comply with Indian taxation laws, including the Goods and Services Tax (GST) Act and related rules.
· Sellers must provide valid GST registration details, issue compliant invoices, and maintain accurate records for all transactions conducted on Quikermart.
· Buyers must provide correct GSTIN details if they wish to claim input tax credit.
· Quikermart is not responsible for any disputes or penalties arising from incorrect tax information provided by users.
· Invoices generated through Quikermart are for documentation purposes only and do not replace statutory tax invoices unless otherwise indicated.
· This clause ensures transparent and lawful trading practices across all B2B hosiery transactions conducted via the platform.
28. Bulk Orders & Custom Manufacturing
· Quikermart facilitates bulk and custom hosiery orders between manufacturers and buyers.
· For large-volume or made-to-order requests, buyers must confirm order details, specifications, and delivery schedules in writing.
· A non-refundable advance payment of up to 50% may be required to initiate production.
· Cancellations after production commencement will result in forfeiture of the advance and liability for any raw material or labor costs incurred.
· Estimated delivery timelines for bulk orders are communicated at the time of order placement and may vary based on manufacturing capacity.
· This clause provides clarity on pre-production commitments, ensuring fairness and reducing disputes in large-scale B2B transactions.
29. Counterfeit & Brand Protection
· Quikermart strictly prohibits the sale or distribution of counterfeit, imitation, or misbranded hosiery products.
· Sellers must ensure that all goods bearing brand names, logos, or trademarks are legally authorized for sale and distribution.
· Quikermart retains the right to investigate, suspend, or permanently ban any seller found engaging in counterfeit activities.
· Verified brands may request takedown of infringing listings by submitting proper documentation or proof of ownership.
· Sellers violating this clause may face permanent account termination, loss of funds, and possible legal proceedings under the Indian Copyright Act, 1957 and Trade Marks Act, 1999.
